HomeTownCareers.com and its subsidiary regional sites, (collectively
referred to as the “Site”). Resmatic, Inc. “We, Us,
Our”, is the publisher of the Hometown Careers Network and may
revise these Terms of Use at any time at its sole discretion by
updating this posting.
Proprietary Rights
We authorize you to view and download a single copy of the Site
solely for your personal, noncommercial use. The concept, design,
software, “look and feel”, contents and other
“Material” pertaining to the Site is our exclusive
property. Unauthorized use of the Material may violate copyright,
trademark, patent and other laws. You may not use the Material in any
way for any public or commercial purpose, including copying to

Acceptable Use
The Site is available for use by individuals only for the purposes
of seeking employment or career information, and by member companies
in posting and otherwise advertising their jobs. The Site may not be
accessed by automated scripts, machines, or robots of any type. You
may not use the Site to upload, post, transmit, email or otherwise
make available any material that a) is in violation of any law or
regulation, b) infringes on the intellectual property rights of any
party, including patents, copyrights, trademarks and trade secrets,
c) violates another party’s privacy or other personal rights,
d) is harmful, libelous, abusive, obscene or otherwise objectionable,
e) is unsolicited advertising, junk mail, spam, a
multi-level-marketing or pyramid scheme or any form of solicitation
not related to employment. You may not impersonate another user or
entity, or modify or delete information posted by another person or
entity. You may not respond to a job posting only if you are an
individual applying for that job. Recruiters may not respond to job
postings on behalf of another individual or in an attempt to sell
services to the company making the posting.
Registration
The use of certain areas of the Site is restricted to registered
users who have provided an identifying email address and selected a
password. You are responsible for keeping your password confidential,
and are responsible for all uses of your registration, whether or not
authorized by you. You agree to immediately notify us of any
unauthorized use of your registration or password.
Privacy Policy
Registration data and certain other data about you is subject to our
Privacy Policy accessible from the site homepage link entitled
“Privacy.”
User Content
Users may post information, data, text, and other content ("User
Content") to its Site. Such User Content may be viewed and used by
other Users who visit the Site. You agree that any User Content you

profile information. We do not screen such information and make no
representation as to its reliability, accuracy, safety or legality.
We do not act as an employer, employment agency or recruitment
agency with respect to the use of the Site, and are not responsible
for any employment decisions made between job candidates and
employers. We do not warrant that individuals using the Site are who
they claim to be. You assume all risks associated with other users
whom you come in contact with through the Site.
We are under no legal obligation to, and generally do not, control
the information provided by other users that is made available
through the Site. Such information may be offensive, harmful,
inaccurate or deceptively labeled. We expect that you will use
caution and common sense when using this Site.
You acknowledge and agree that you are solely responsible for the

therein placed by you on the Site. Companies are solely responsible
for their postings on the Site.

WARRANT THAT THE SITE AND ITS FUNCTIONS WILL BE UNINTERRUPTED OR
ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE IS
SECURE AND FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT DATA
WILL NOT BE LOST. RESMATIC DOES NOT WARRANT OR MAKE ANY
REPRESENTATIONS REGARDING THE SITE OR THE RESULTS OF THE USE OF THE
SITE IN TERMS OF THEIR CORRECTNESS, ACCURACY, OR RELIABILITY.
Limitation of Liability
Our cumulative liability to you for all claims relating to the Site,
in contract, tort, or otherwise, shall not exceed $100. In no event
shall we be liable for any consequential, indirect, special, or
incidental damages, including but not limited to loss of data or
interruption of business, even if we have been advised of the
possibility of such potential loss or damage. The foregoing

Termination
We reserve the right, at our sole discretion, to pursue all legal
remedies, including but not limited to deletion of your information
from the Site and immediate termination of your registration with or
ability to access the Site and/or any other service provided to you
by us, upon any breach by you of these Terms and Conditions or if we
are unable to verify or authenticate any information you submit tothe
Site.
Indemnity
You agree to defend, indemnify, and hold harmless us, our officers,
directors, employees and agents, from and against any claims, actions
or demands, including without limitation reasonable legal and
accounting fees, alleging or resulting from your use of the Material
or your breach of the terms of these Terms of Use.
Miscellaneous Terms
Except as expressly provided in the Terms and Conditions for a
particular area of the Site, this agreement represents the entire
binding agreement between you and us, and each party’s
respective successors and assigns, and supersedes any previous
agreements, oral or written. This agreement may be amended only in
writing signed by both parties. This agreement shall be governed by
the laws of the state of California and the United States of America.
Federal and state courts located in San Francisco shall have
exclusive jurisdiction to adjudicate any dispute arising out of this
Agreement or use of the Site. If any part of this agreement is held
not to be enforceable, the other terms of this agreement shall not be
affected by such holding. We may modify these terms of use by posting
the modifications to this page. Your continued use of the Site
constitutes your acceptance of the modifications.
